How To Win Child Custody For Fathers

By Ines Flores

There is a general perception that child will always be left to the mother in case of a divorce. This is however not true, in fact, the father has equal legal rights, just as the mother when it comes to the child's custody. However, this can be so difficult, particularly in case the mother is also filing for the same, whether it is full or just a joint custody. For those who are wondering how to win child custody for fathers, here are some tips.

First, it is important that the dad provides a history of providing for the kid's support. As such, if you have been paying for the upkeep, you must continue doing so, but if you were not paying, then it is never too late. This can be done formally or informally through arrangements with the kid, s mother. In all cases, it is important to keep the documentation proof such as the correspondence letters with the mother and the receipts.

The second most important thing is to build a strong and lasting relationship with your kid. If there is no court injunction stopping the father from seeing the kid, then he should be in close contact, by frequently calling to check the child's day. He should also visit physically, and be in contact with the school, introduce himself to the administration and make sure that the kid knows he is available for any kind of support.

There is a need for maintaining a proper visitation schedule as this may also be needed in the court. There should be a parenting plan available. Such plans help the dad not to skip or forget the important days or their visiting day. The dad should also introduce himself to the school administration.

In addition to this, the dad should attend the special days in school. These could be the educational events, religious events or just social events but they serve as evidence that father has a meaningful relationship with the kid. Some days that should not be missed include the baptisms, birthday parties, school plays, closing days, and sporting events among others.

You must also be on the lookout for any obstacle that can prevent the judge from making a decision that favors you. The most important of these is the paternity test that could prove otherwise. This is a major consideration particularly when the two are not married.

The best interest of the child is what is used to make the final determination. As such, father must be able to explain the best interest, and more importantly, explain why leaving the kid with his/her mother is not in his/her best interest.

There are better ways of fighting for the custody as an alternative to a full hearing. The two other options are arbitration and mediation that are less costly. However, whether this is a full hearing, mediation, or arbitration, it is very necessary that you seek the services of a well experienced lawyer to help you out as this can make a big difference.
